Acceptable Use & Messaging Policy

Rules for lawful messaging, sender identity, recipient permission, anti-abuse controls and WhatsApp Business use.

This document forms part of the Ozibus Public Website Legal Centre. It should be read together with other policies that apply to the services and channels you use.

3.1 General acceptable use

Ozibus must not be used to:

  • send unlawful spam;
  • use purchased, harvested or improperly obtained contact lists;
  • send phishing or fraudulent content;
  • impersonate another organisation;
  • use an unauthorised sender identity;
  • evade unsubscribe or suppression controls;
  • distribute malware;
  • facilitate scams;
  • harass, threaten or exploit individuals;
  • distribute unlawful sexual or exploitative material;
  • facilitate terrorism or serious crime;
  • infringe intellectual-property rights;
  • probe or attack systems without authority;
  • circumvent rate limits or abuse controls; or
  • use Ozibus in a manner likely to cause material harm to networks, carriers or Ozibus's reputation.

Customers sending marketing communications must maintain evidence supporting recipient permission.

Ozibus may inspect metadata, complaints, delivery patterns, bounce rates and abuse indicators to enforce this Policy.

Ozibus may throttle, quarantine, reject or suspend communications reasonably suspected of violating this Policy.

3.2 WhatsApp Business messaging

If the WhatsApp channel is enabled, customers must use it only in accordance with applicable law and the current WhatsApp Business Messaging Policy, WhatsApp Messaging Guidelines, WhatsApp Business Terms of Service and related Meta requirements.

A customer may contact a person on WhatsApp only when it has the person's mobile number and the opt-in permission required by WhatsApp and applicable law. The customer is responsible for the method, scope and evidence of opt-in and should ensure recipients reasonably expect the categories of messages they will receive.

Customers must respect every valid request to block, discontinue, unsubscribe or otherwise opt out of WhatsApp communications, whether the request is made on WhatsApp or through another channel. Suppression controls must prevent routine re-contact unless a lawful basis and any required new permission exist.

Customer-initiated conversations must use approved WhatsApp message templates whenever required. Outside the applicable customer-service window, customers may send only message types permitted by WhatsApp. Template approvals, message categories, service windows and platform requirements may change from time to time.

Customers must not bypass or attempt to bypass business verification, template approval, messaging limits, quality controls, message categories, rate limits, policy enforcement, account restrictions or other safeguards imposed by Ozibus, Meta or WhatsApp.

Where automation is used for WhatsApp support, customers must provide any escalation path required by WhatsApp policy and should ensure recipients can reach an appropriate human or alternative support channel where necessary.

Customers must maintain accurate WhatsApp business-profile information and must not impersonate, misrepresent affiliation with, or use the name, trade mark or identity of another person or organisation without authority.

Ozibus may reject, suspend or disable WhatsApp functionality if a WhatsApp Business account, phone number, template, message category or customer is restricted by Meta/WhatsApp or if continued processing would expose Ozibus, a provider, recipient or third party to material legal, security, fraud, spam or reputational risk.
