This document forms part of the Ozibus Public Website Legal Centre. It should be read together with other policies that apply to the services and channels you use.

Ozibus supports legitimate transactional and commercial communications across channels including SMS, MMS, email and WhatsApp Business messaging.

Current Ozibus channel infrastructure: Twilio is the underlying provider used for Ozibus SMS and WhatsApp Business messaging, while Ozibus email delivery uses Namecheap-hosted private email infrastructure. Meta/WhatsApp, telecommunications carriers, recipient email systems and destination networks may also participate in delivery. These provider arrangements do not reduce the customer's responsibility to obtain consent, use authorised sender identities, honour opt-outs and comply with applicable law and channel rules.

Customers using branded SMS or MMS sender identities in Australia must satisfy applicable Australian SMS Sender ID Register requirements.

Ozibus may require verification of:

  • customer identity;
  • organisation details;
  • authority to use a sender ID;
  • relationship between the sender ID and the organisation; and
  • any additional information required by Ozibus, its telecommunications partners or regulators.

An unverified or unregistered sender identity may be rejected, replaced, labelled by telecommunications networks or otherwise restricted.

Customers must not:

  • use another organisation's sender identity without authority;
  • misleadingly imitate government, financial, delivery or other trusted brands;
  • rotate sender identities to evade enforcement;
  • use Ozibus to circumvent sender-registration requirements; or
  • send commercial messages without required recipient consent.

Australian commercial electronic messages must comply with applicable consent, sender-identification and unsubscribe requirements.

The Australian SMS Sender ID Register applies to branded SMS/MMS sender IDs; it does not itself verify sender names used inside messaging applications such as WhatsApp. WhatsApp messaging remains subject to applicable Australian spam and privacy laws and to WhatsApp/Meta platform rules.

For Australian recipients, a commercial instant message may fall within the Spam Act 2003 (Cth). Customers using WhatsApp for marketing must therefore assess and satisfy applicable consent, sender-identification and unsubscribe requirements in addition to WhatsApp-specific opt-in rules.

For WhatsApp Business messaging, customers must obtain the permissions required by WhatsApp before initiating communications, honour opt-out and blocking requests, use approved message templates where required, maintain accurate business-profile information and comply with applicable business verification, content, quality, category and messaging-limit rules.

Meta or WhatsApp may review, reject, pause or restrict templates, messages, numbers or accounts and may change channel rules. Ozibus may enforce corresponding restrictions and cannot guarantee restoration of a WhatsApp asset that has been limited or disabled by the channel provider.

Ozibus may retain records relevant to consent, suppression, complaints and sender verification where reasonably necessary for legal compliance and abuse prevention.
